Rights?
It never ceases to amaze me how far our courts go to protect the rights of the (suspected) criminals, but do little to protect the average citizen from daily monitorig. Remember this excerpt from a Washington Post article in Aug 2009?
The Obama administration will largely preserve Bush-era procedures allowing the government to search — without suspicion of wrongdoing — the contents of a traveler’s laptop computer, cellphone or other electronic device, although officials said new policies would expand oversight of such inspections.
The policy, disclosed Thursday in a pair of Department of Homeland Security directives, describes more fully than did the Bush administration the procedures by which travelers’ laptops, iPods, cameras and other digital devices can be searched and seized when they cross a U.S. border.
Can't track a "suspect" via GPS, but can search "without suspicion of wrongdoing" any laptop, cellphone, etc.?

Where's the average citizens privacy?
These federal judges worry about a suspected criminal's privacy but it's alright for any company that I deal with to take my information and sell it to other companies. Who's protecting my privacy?
Anytime you have a 50-50 chance of getting something right, there's a 90% probability you'll get it wrong.
That's what he said
Can't track a "suspect" via GPS, but can search "without suspicion of wrongdoing" any laptop, cellphone, etc.?

He did not say anything about the GPS in a cell phone can't be tracked. What is meant by the statment I believe is that our government in the past has tracked people using laptop, cellphone, and GPS without their knowledge. These are people that have not done anything wrong.
OK

Cell phones can be tracked as the move from tower to tower. They've been doing it for years. It isn't real-time which is the advantage given through GPS.

Two sides of a story
An arrest warrant had been issued previously. The judge went on to say that if the feds had mentioned that if there was a risk of flight, the GPS warrant would be routine. Yet the article mentions that he was an elusive suspect...There was a happy ending though. The feds caught the guy anyway.

What Stupidity!!!
Whatever it takes to capture a criminal should be used and legal. Criminals have more rights than the abused.
