Montgomery County, MD Speed Camera Class Action Suit

"As mentioned in our earlier posting, a class action suit against the speed camera programs of Montgomery County, Rockville, Gaithersburg, and Chevy Chase is scheduled to go to court on July 12th, 2010. At issue is whether the contract's contingent fee payments violate a provision of state law. However the local government’s liability is limited by a state law called the Local Government Tort Claims Act. Because of this, if you wish to receive a portion of any settlement you will need to send a letter notifying the local government of your intent to make a claim within 180 days of receiving the citation(s). We have prepared sample letters along with mailing information and instructions."

Hopefully, the people will prevail over Montgomery county. I travel to Bethesda frequently and I cannot stand those stupid red light cameras.

I have been in one rear end accident (I was not at fault) b/c of the fear of the red light cameras.

Sorry, but it appears that this suit is over the speed cameras only & not red light cams. ACS runs the speed cams but I'm not sure who does the various red light cams, or how those contracts differ from the speed cams.

I got zapped on East Randolph road but it has been longer then 180 days. I applaud the suit as I drive in DC also and think that these cameras are just a way for governments to make more money.

I live in Bethesda and these speed cameras are killing me with monthly fines for my family doing 40 in a 35 mile zone!!!!!!

Raising the speed limit?

Are the speed cameras in Montgomery County placed on roads where the speed limit should be raised? Where there are no significant safety issues? Or should folks just slow down? Since I don't get over there very often I'm not sure of the situation.

Has there been any survey as to which County officials are authorizing the placement of cameras? Should there also be a movement to remove them from office???

All the speed cameras in Montgomery County are in school zones. Most of these areas are also residential but there are some major arterials that border the schools. Examples near me are Seneca Valley HS, Northwest HS, Damascus Elementary and Damascus High. The speed limit on Rt 27, Ridge Rd drops to 30 when it enters the heavier residential area about 3/4 mile BEFORE the school heading north but traffic regularly zips along at speeds up to 55 and 60. There have been numerous crashes on Rt 27, many fatal but people still refuse to slow down and follow the posted limits of 40 and 30.

Along Great Seneca Highway the speed limit is changed from 45 to 35 during hours when kids are in school using variable signs but traffic still tries to do around 50 or better. Middlebrook road and Wisteria Dr. also see high rates of speed. Middlebrook in that area has also been the scene of many fatal crashes but people still travel at high rates of speeds even though traffic lights have been installed to help slow the flow.

So, are speed cameras unfair in Montgomery County?

I got nailed on Georgia Ave, near Brook Manor Park (don't know exactly where). The speed limit changes all of a sudden.

At the time I didn't have POI-Factory's database sad

If I didn't throw my speed ticket away, I would join the class action lawsuit!

Speed cameras in school zones

I never thought about that before. I think you are right that the majority are by schools (although I think a few are not, unless the school area is a few blocks). Red lght cams are all over the place and not limited to schools.

I have no problem with causing people to slow down by schools when in session. It is the other locations and times that are an issue for me

But the lawsuit is regarding the contract method, which allegedly violates the intent of the law authorizing local use, and gives the operators (ACS) a per ticket incentive.

You should be able to get a copy online with either your ticket number and/or reciept. Or, you can contact the Safe Speed Customer Service Center toll free at 866-818-3844 and work through the options to get an operator and give them your tag number, etc. and get a copy.

Interesting. I am pretty sure that the cameras aren't even activated unless it's 10+ MPH over. I pass several of them frequently going above the posted speed limit but less than 10 over and haven't gotten a ticket.

There have been mentions of the county upgrading some cameras to laser -- apparently on tight roads like Connecticut Ave, the radar can't differentiate between multiple cars that are captured in one image. Good thing, those tickets aren't issued. Bad thing, laser is more accurate and they will start issuing the tickets if upgraded.

Speed cameras in MD

State law which went into effect on October 1 set the tolerance at 12 MPH over the posted limit for cameras. I wonder if it's the same for police officers issuing tickets.

Speed Cameras

Interesting to note that the rise of speed cameras in Montgomery County are amazingly well correlated with Ike Leggett & the County Council running a deficit of the better part of $ 1 B. They continue to try to avoid instituting substantial cuts to the budget. Guess what that means for the spread of Speed Cameras???

Folks should be driving and paying attention to the road, not talking on the phones, drinking or scratching their body parts while behind the wheel. I also strongly believe that speed limits that slow encourage people to perform alternative activities while driving, paying less attention to the roads. There is nothing that doesn't let driver who pays attention to operate any modern vehicle on 60 MPH on Great Seneca between Darnestown and Clopper rd or street like that safely under normal weather conditions.
