Out of State Handicap Placard usage in CA

 

This is a FYI..

Hi we were parked in a H/C spot at the IHOP mentioned below. A Deputy from the Sheriff's department came over told us that out of state (FL) Handicap placards were not recognized in CA.

Situation: We were visiting our Son and using his car. My wife offered to show the Placard Registration to the deputy and she said it was not necessary, but to be aware of the law. She would not give us a summons this time..

Found this on the internet and fired off an email to local Sheriff in this area, asking for clarification

V C Section 22511.5 Disabled Parking Authorized Parking Zones

Disabled Parking: Authorized Parking Zones

22511.5. (a) (1) A disabled person or disabled veteran displaying special license plates issued under Section 5007 or a distinguishing placard issued under Section 22511.55 or 22511.59 is allowed to park for unlimited periods in any of the following zones:

(A) In any restricted zone described in paragraph (5) of subdivision (a) of Section 21458 or on streets upon which preferential parking privileges and height limits have been given pursuant to Section 22507.

(B) In any parking zone that is restricted as to the length of time parking is permitted as indicated by a sign erected pursuant to a local ordinance.

(2) A disabled person or disabled veteran is allowed to park in any metered parking space without being required to pay parking meter fees.

(3) This subdivision does not apply to a zone for which state law or ordinance absolutely prohibits stopping, parking, or standing of all vehicles, or which the law or ordinance reserves for special types of vehicles, or to the parking of a vehicle that is involved in the operation of a street vending business.

(b) A disabled person or disabled veteran is allowed to park a motor vehicle displaying a special disabled person license plate or placard issued by a foreign jurisdiction with the same parking privileges authorized in this code for any motor vehicle displaying a special license plate or a distinguishing placard issued by the Department of Motor Vehicles.

Amended Sec. 12, Ch. 404, Stats. 2004. Effective January 1, 2005.
Amended Sec. 11, Ch. 478, Stats. 2010. Effective January 1, 2011.

Will f/u when I get a response from the OC Sheriff.

BTW: Maybe its a good idea when visiting a city/state to check with local officials on their laws. Of course be prepared to receive numerous responses.

I do believe that the LEO could be in violation of the Americans with Disabilities Act by not recognizing the Handicapped permit.

California does not recognize out of state placards. One can obtain a "visitors" placard via California's DOT... of course they'll be a fee for that... Florida recognizes all states placards for visitors...

as far as I know

the ADA only covers the number of spaces, size of said spaces, and signage required for said spaces and not who is allowed to use them...

I read the rule as if you are a visitor and do not have a permit, the state will issue a visitor placard with proof or certification. I also note the rule regarding a parking permit. I take that to mean a special permit is needed for long-term parking which would be for more than 1 day such as in a municipal lot.

To me, that implies I'm a visitor and I left home without mine.

You're assuming...

Go to the link... look at other states rules... for example: Iowa recognizes other states placards. So does Florida. California does not. So, obviously if you have a placard from your home state, you still need one issued by California because they don't recognize placards from other states. All one needs to do is download the California form, fill it out, send it in, get their placard... an all will be well.

Passing through

If you are only passing through CA. how can you apply and wait two weeks to get one?
If you come in by plane and rent a car it makes no sense to apply. And how would you get a doctor to fill one out?

While in CA, FL H/C placard on FL car only.

Since you were driving (or ridding) a car with CA license plate but display a FL H/C placard, you are likely to get a ticket if you are away from the vehicle. In your situation, the deputy recognized (verified) your situation so you did not get the ticket.

If you need to rent a car, talk to rental agent and show your out of state H/C placard when picking up the rental car.

This article below from the OC Register also has a DMV spokesperson saying that in "most" places in California an out of state placard should work, but it might be a good idea to get a temp CA one from the DMV in case you run into an officer that doesn't know the law. According to V C Section 22511.5, it sure sounds like placards from other jurisdictions are recognized in California. I guess the only question is if a local ordinance differs from the state vehicle code?

Out of State Handicap Placard usage in CA

Hi all... thanks for your responses... All very logical and detailed.

Summary: I have not heard back from the Sherrifs office in Orange County.

When visiting in CA/OC, will take a minute to go thru the proper channels and get a TEMP H/C sticker/placard. This way avoid all possible issues.

In New York

Handicap tags in New York are blue except for New York City.

In NYC they are red and the only ones valid. Park with a blue and you will get ticketed / fined.

there would be a problem out of state. How long does it take to get a Ca visitor handicap placard. Also what do they charge.

CA give a hefty fine for handicap parking violation,
even just pulling in/out or stopping on handicap sign.

My suggest that they should posted sign that "CA handicap permit only required."

NYC placards

I have a NY state handicap placard and it is blue, as far as I know the red placards are only temporary and have a much shorter life span. (usualy for short time handicaps)
In New York City, the state permit is valid only for handicapped spots off the street. New York City does not set aside handicapped parking spaces on the street, but the city's handicapped parking permit allows the user to park in many "No Parking" zones along sidewalks.

I am from nyc too and...

NY has a few rules to this. There is the blue hanger that is for a permemnt person (that can ride any car) to park where it is authorizede by a sign. A blue hanger that is for a temp person for any car to do the same, A red sticker ONLY for NY city parking that can park almost anywhere only in the city. and then you got the actual license plate that is a handicap plate .. not really sure what that does. I think it doent need to be updates as offen. not sure

Reason I know this is that My daugther has down syndrome and has a perm. hanger for what ever car she go in, she can use.

A reminder.. if she is not in the car, we can not park in a handicap area.

I was in tight quarters in a tiny parking lot this weekend and actually had to back into a HC spot for about 30 seconds to allow the other cars to pull out. I never shifted into park or anything; just trying to get out of everyone's way as they left the lot so I could take one of the newly available spots.

I suppose I could have been ticketed for that 30 seconds. I guess that's the risk of living life on the edge. smile

Handicap plate

I have a handicap plate form Ontario, Canada and when I go to Florida I can park on a metered spot without paying. In Clearwater Beach you can use parking on the street for 4 hours, but if you go to a parking lot without attendant you can park for long time.
You never know what are the rules, but before I go I search for more info. Same towns you have time limit.
I went to Europe and I took my plate so I could park on the handicap spots, but many places you have to pay even on the street.
