Cop RL Tickets Ruled Unconstitutional

Sounds about right, can't ticket for same violations at the same location twice with two different means...either the RL ticket or the cop, one or the other only.

I think the implication goes beyond that.....

They are not saying police cant issue tickets at the location of the RLC, but that as long as RLC exists in the City/ Town, then Police can not issue tickets for RL violations within that geographical area, since the fine and points for a Police written ticket is different from that of the RLC. Its like saying since someone took a picture of you committing a crime, you just get a fine, but if the cops catch you doing it you go to jail. You cant have it both ways. I believe they would have to make the fine and point schedule the same for all violations. This conflicts with the RLC theory that there are no points because you are not ticketing the driver but the registered owner of the vehicle.

It will be interesting to see the out come of this,St.Petersburg Fl has been in process of starting up red light cameras lets see if they change their minds.Thanks for the information.

Let me get this straight. They're not talking about intersections with red light cameras, but intersections in general?

Here in Ohio

I wondered how they could get away with the violations of our 6th amendment right to face our accuser. Here in Ohio what they did was de-criminalize it. Running a light is a civil offense not a criminal offense. Which actually led me to think very much like this judge. Cops can't stop you now...not acting in their authority as a cop anyway. As a citizen I suppose they could sue me in court.

This is definitely an interesting case. Have two different penalties for an intersection is low equal justice. In fact, what happens if you run a red light at an RLC intersection and an office gives you a ticket. Do you get two different penalties? The State is going to have to pick one penalty or the other but not both.

In the end, there will probably be some sort of carve-out/exclusionary statute written (similar to the hacked Orwell quote above).

This new ordnance will designate red-light-camera intersections as some kind of special safety/security zone. Tickets issued within these zones will be of a "different order" than other tickets through-out the city.

Yes.. that's how I read it. Doesn't mean I'm right, but only how I interpreted it. If a city or county has RLC's and you blow through a red light "without" and a Cop sees you.. he can't give you a ticket because the existing red light law (per a RLC), has a different penalty than one without.

Some officers in my city has relaized that people slow down on red light/speed camera. So they have started to laser/radar people one or two traffic lights before the speed camera signal. Summer is the season when cops need to make revenue for the city police by handing tickets. You would rarley see an officer standing in -30C (-22F) out to laser.. razz
