Ticket for Cell phone in California

No, I did not get a ticket-- but someone else did. I thought everyone would get a kick out of this-- Money hungry California.

Q. I got cited for using a cell phone without a hands-free device. I was told by the officer that the ticket was only $20, and the DMV site also says $20 (but that other fees may be included). My other fees were $80 or so. I agree with the law, but that seems excessive. Where do the other fees go?

A. That $20 figure is as misleading as a sub-prime lender.
All traffic citations carry other monetary burdens besides the fine itself. Voters, state lawmakers and county supervisors can add assessments to a fine to raise funds or cover costs for various governmental programs.
Carole Levitzky, a spokeswoman for Orange County Superior Court, provided ol' Honk with the breakdown of actual costs for a citation for driving and talking on a cell phone that is not hands-free:
•Base Fine: $20
•State Penalty Assessment: $14
•County Penalty Assessment: $20
•DNA Penalty Assessment: $4
•Court Construction: $3
•State Surcharge: $4
•Emergency Medical Services Penalty Assessment: $4
•Night Court: $1
•Court Security: $20
In all, 90 clams.

Maybe folks can't afford a $40 headset with the car payments, insurance, gas etc.

$40 that's expensive...
You can get one for $20 at Walmart in the states. Granted it may not work as well as a more expensive one. Also I was at a Big Lots and saw stereo headphones with a mic for $5. It would work with any phone that had the 3.5mm or 2.5mm headphone jack. Of course if your phone has no headphone jack it will not work.

First of all, I couldn't text (with my fat old fingers) if I were sitting on my sofa at home; much less trying to dirve a car at the same time.
I would be all for a law that outlaws use of a moble phone by the driver of a car while the car is in motion.
If you have to make a call/text, pull over to the side of the freeway and stop the car before you use your cell phone!

This is exactly what I do, pull off somewhere before using the phone. Today I found a nice empty parking lot to use.
Shame the left lane is full of people on the phone oblivious to the driving that is going on around them.

and how is this any different from fiddling with a phone. I drove to work with one hand on the wheel today. And most people reading this have driven with one hand before. I don't think it mattered what my other hand was doing, as long as my focus stayed on the road. Can someone please tell me why I can drive with one hand on the wheel, but as soon as that other hand is holding a phone, it is illegal?

If you can stay focused on the road, then I would have no problem with it. I must admit that I answer my phone while driving (if I decide I need to make a call, I pull over and stop).
However, my experience is that people who tailgate me are almost always talking on their phone. They do not seem to realize how close they have gotten to my vehicle, which implies to me that they are not "focused" on the road, but rather on their phone call.
I recall a Mythbusters episode where they tested using cellphones while driving and concluded that a persons driving ability was significantly impaired.

there are literally tens, maybe hundreds, of thousands on laws on the books. Most are needed to cover off the stupid things people do, the people who don't have common sense to protect themselves or others.
Ironically, these laws are doing more and more to protect these stupid people from their timely demise, thus thwarting natures culling of less 'fit' species.
Stupid people get to live longer, have kids, who often continue in their parents stupid ways - thus requiring more laws to protect the species.

we have same cell phone law here.. statewide, you can read texting, but you CAN'T type.. hard to clear of it if got caught. So, I always keep away from reach of mobile phone when driving. Glad that I have BT on my NUVI 670 which works.

Driving around with a jammer to block the signal could help as well. Just about every day I almost get hit, not a big fan of it.
Compared to the few countries I have driven in, the US has been the worst overall. Canada has been the best.

Using a jammer is illegal in the US. In a lot of areas it will get you quickly noticed by your local law enforcement officer as many of their radio systems operate close to the cellular frequencies.

$100 Seems Cheap To Me
I recently had a friend killed in a traffic accident. He was stuck in standstill traffic when a car slammed him from the rear setting off a chain reaction crash killing my Friend his passenger and a back seat passenger in the car in front of him and the driver that hit him. The accident report showed no signs of drugs or alcohol in her system, but every witness said the driver was talking on her cellphone
Also as a taxpayer I bet when factoring in the time of the officer, the processing of the ticket by the court and DMV, the time of a bailiff or two, court clerk and recorder, and the judge all add up to cost far more than the $20 fine. Even if it means tacking on added fees I would rather the person who violated the law cover the full cost of his transgression than law abiding citizens paying any portion of it.

I know it is illegal here in the US, but wish it were possible though. I should have specified, I wasn't in the US at the time.

Driving to breakfast this morning, the woman in front of me is all over the road. You can tell she's driving a manual transmission because, the car slows between each shift, WHY YOU ASK, because she has her OTHER HAND HOLDING HER PHONE TO HER EAR!! (Where's a cop when you need one)

But seriously, I don't believe it's the talking that's dangerous, it's the driving with one hand. I was setting in the car waiting for my wife and a lady that was parked nose to nose with me came out and got in her car, the first thing she did was pull out the cell phone and make a call then it took her forever to get out of the stall because she had to keep switching hands with the phone.
My wife says I'm sexist but from my observations I think the group that has the most cell phone usage while driving is women in the teen to maybe the early thirtys.
Anytime you have a 50-50 chance of getting something right, there's a 90% probability you'll get it wrong.
