Problem with Nuvi 3790LMT

My Nuvi 3790 switches between 3D and 2D view while I'm driving. The voice commands are turned off but it keeps doing constantly. The problem occurs with a destination or not.
Has anyone had problems with their Nuvi 3790 similar to mind, is there a fix? Do I need to send it back?

It's not a common problem so if your able to exchange or return it do so.
