Ads must be new
I have never seen one on my Nuvi 260. Must be part of the traffic add on, or new to newer models.

It's not pre-loaded, it's sent via the "FREE" traffic. It's FREE, although you have to endure the ads, but I think they only appear at slow speeds. Upgrade to the the "Pay" service and the ads will go away.
And no, Garmin isn't being told where you are located. Why would they care anyway?

While its true that Garmin isn't currently given your location info, that may soon change. There was another post recently discussing one of Garmin's new plugins and the fact that the terms of service stated that Garmin was allowed to upload your location info from your GPS. Presumably for marketing purposes.

Your GPS is not capable of transmitting anything by itself so there is no way Garmin could gather anything from it over the air.
On the other hand, I just read elsewhere that there is a test going on right now in Europe where Tomtom is gathering trip information from the GPS when the user connect it to their computer/internet. This is done with the user consent, for the purpose of developing new maps (called HD Maps) in relatively uncharted areas like Romania.
